You are breaking that term as you are charging more to accept that method than you are others, therefore, the terms of service are broken.

Is your stock physical or brokered?

If you're looking to counter Paypal's fee's, which you are, suggest using Masspay instead.

Also, have you checked the proper certification is present with these phones?

I know of a bunch of fake P168C's which were circling about that were not regulated, and thus illegal to sell.

Do you have copies of the documents? I wouldn't touch trying to sell something like this without them, too much litigation to be risked.
